Under 21 DUI

Being arrested and charged with DUI can lead to harsh and severe penalties, especially if you are underage. In fact, the penalties imposed by a judge will often be enhanced because of a driver being under 21 and illegally drinking. In many cases, a conviction can lead to DUI penalties such as:

Zero Tolerance in Underage Drinking

There is a strict Zero Tolerance policy in the state that restricts a driver under the age of 21 from driving with alcohol in their system, even if their BAC level is below .08%. A driver license will be suspended immediately if they are found to have a blood alcohol concentration level even at .01% after taking a chemical test or Preliminary Alcohol Screening test or if they refuse to do so. Those that are found to have a BAC level at .08% or above will face additional penalties on top of the ones that may already be imposed. California Vehicle Code (CVC) §23136 regulates the occurrence of underage drinking and driving.

Police will advise you of your right to remain silent, but will also try to get you to answer their questions, sometimes with the use of promises for leniency, or even threats if you do not participate. Under these circumstances, clients typically fare better when they simply state that they do not wish to say anything and ask for a lawyer.
