First DUI Offense

If you have recently been pulled over and asked to complete a field sobriety test such as a blood test or breathalyzer test, chances are the officer suspected that you were driving under the influence of alcohol or drugs. In the state of California, the law has made it very difficult on drivers who are suspected to be drinking and driving. It clearly states that any person who has a blood alcohol content level at or above .08% or is clearly intoxicated will be arrested for DUI. With this in mind, an officer may be overzealous in their attempt to arrest a drunk driver and mistake other behaviors for drunkenness.

What to Expect in First Time Charges

A first time offense can lead to penalties including up to $1,000 in fines, six months in the county jail, probation up to five years, driver’s license suspension up to ten months and an alcohol education program. By example, a person who has poor vision is driving at night without their glasses. They cross over the lines several times before being pulled over by an officer on suspicion of drunken driving. While the person can plead their case to the officer, he or she may simply think that they need to arrest this person because they are a danger to the road. Without administering proper sobriety testing, this person is then charged with DUI. While not every case will be the same, we understand that being charged with your first DUI will be frightening, and you will be unsure of where to turn.
