Field Sobriety Tests

If you have been stopped by an officer for possible DUI you may be asked to take part in a Field Sobriety Test, FST. The officer may or may not tell you that the test is voluntary. The results of the FST will be used by the prosecution to prove you were impaired at the time of the test. However there are many other reasons why a person might not perform well during one or more of these tests. If you were informed that you failed the test and were arrested, or that you failed a breathalyzer test, or a blood test, you need to obtain the services of a skilled attorney to assist in your DUI defense.

Types of Tests

There is a federal agency which issues police protocols for DUI field sobriety testing, the National Highway Traffic Safety Administration (NHTSA). According to this agency there are only three tests reliable enough to determine if an individual is too impaired to drive safely. These are:

  • The horizontal gaze (nystagmus test) which measure eye coordination
  • The one-leg stand tests balance and muscle control
  • The walk and turn tests your balance, coordination and ability to carry out instructions

There are a number of problems with these tests and the administering of them which an experienced field sobriety test lawyer with our firm may be able use in your defense against the DUI charges.

Many officers administer a variety of other tests as well which are not recommended by the NHTSA but for some reason remain in use. The fact that they are not part of the recommended protocol makes it possible to have those test results excluded from the prosecution's case against you.
